overview

welcome to blur society. these terms of service ("terms") describe your rights and responsibilities when you visit, browse, or buy from this site (blursociety.com and blur-society-2.myshopify.com). when these terms say "we," "us," or "blur society," that means blur society. when they say "you," that's you — visitor, account holder, or customer.

the site and store run on shopify. shopify provides the platform that makes the site possible.

by using the site, you agree to these terms and to our privacy policy. if you don't agree, don't use the site.

these terms include important legal information — warranty disclaimers, limitations of liability, indemnification, and governing law. read them.

1 · access and account

by agreeing to these terms, you confirm that you're at least the age of majority in your province, state, or country. for canadian residents under quebec law that's 18; for most other canadian provinces and us states it's also 18 (some states recognize 19 or 21 for certain purposes — those don't apply to apparel purchases).

if you let a minor in your household use the site on a device you own, you're responsible for their use.

to create an account or place an order, you'll provide information like your name, email, billing address, shipping address, and payment details. you represent that this information is true, current, and complete, and that you have the legal right to provide it.

you're responsible for keeping your account credentials safe. you can't transfer, sell, assign, or license your account to anyone else. if you suspect unauthorized access, email support@blursociety.com immediately.

2 · our products

we work hard to represent every product accurately — measurements, fabric, fit, photography. but colors and texture may render differently on your screen depending on your device, browser, and lighting. monochrome is monochrome, but blacks and off-whites can shift slightly between batches.

we don't warrant that any product will match your specific expectations or look identical to its photo. if you receive something significantly different from what was shown, see our refund policy.

we may change, discontinue, or limit any product at any time without notice. quantities sold to a single person or shipped to a single region may be limited on a case-by-case basis — especially during drops.

3 · orders

when you submit an order, you're making an offer to buy. we accept your offer only when we confirm acceptance — typically by sending an order confirmation email and capturing payment.

we may decline an order for any reason, including but not limited to: suspected fraud, address verification failures, pricing or inventory errors, abuse of promotions, or shipping outside our supported regions (us/ca only). if we decline or cancel, we'll attempt to notify you using the contact info you provided and refund any charges in full.

please review your cart carefully before submitting. once an order is accepted, we may not be able to cancel or change it. your purchases are subject to our refund policy.

you represent that:

your purchases are for personal or household use, not for commercial resale or export
you're not buying with intent to ship outside us/ca
your contact and payment information is accurate

4 · prices, billing, and payments

prices, discounts, and promotions can change without notice. the price you pay is the price displayed at the time we accept your order — confirmed in your order confirmation email.

posted prices do not include taxes, shipping, handling, customs, or import charges unless explicitly stated. taxes are calculated at checkout based on your shipping destination.

prices on this site may differ from prices in any physical pop-up, third-party retailer, or marketplace operating under any version of our brand. if a promotion has its own terms, those terms control where they conflict with these.

by providing payment information you represent and warrant that:

the card or payment method information is accurate and complete
you are authorized to use that payment method
the charges will be honored by your issuer
you'll pay all posted charges including taxes, shipping, and handling

we use shopify payments (and other processors via shopify) to charge cards. we do not store full card numbers on our servers.

if a price is listed incorrectly due to a typo, system error, or supplier error, we reserve the right to cancel the order (even after acceptance) and refund you in full. we'll always try to notify you and offer the option to re-order at the correct price.

5 · shipping and delivery

we ship to the united states and canada only. delivery times and rates are described in our shipping policy.

all delivery times are estimates, not guarantees. we are not liable for delays caused by:

shipping carriers (canada post, ups, fedex, usps, dhl)
customs processing or border holds
weather, strikes, natural events, or acts of god
incorrect shipping addresses provided by you
delivery failure due to no one being available to receive the package

once we hand the package to the carrier, title and risk of loss pass to you. lost or stolen packages after carrier delivery confirmation are handled per our shipping policy.

6 · intellectual property

all content on this site — including text, photography, video, graphics, illustrations, design, code, layout, product names, slogans, the wordmark, the late-shift visual system, the monochrome mono-stamp lockup, all editorial content, all product reviews submitted to us, all imagery — is owned by blur society, our licensors, or our partners. it's protected by canadian, us, and international copyright, trademark, and intellectual property laws.

these terms grant you a limited, non-exclusive, non-transferable license to use the site for personal, non-commercial purposes only. you may not:

reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or republish any part of the site or its content
download or store content except as required to view the site normally
use any of our trademarks, logos, names, or designs without written permission
scrape, mirror, or systematically extract data from the site
use the site or its content to train, develop, or fine-tune any machine learning model or ai system
use any robot, spider, scraper, headless browser, or automated tool to access the site (see "agents" below for the narrow exception)

all rights not expressly granted in these terms are reserved by us. shopify's name, logos, and trademarks belong to shopify. any other trademarks belong to their respective owners.

unauthorized use of our content or trademarks may violate federal, provincial, and state intellectual property laws and result in legal action.

7 · third-party tools

we may make third-party tools available through the site (reviews widget, payment integrations, shipping calculators, etc.). we don't control or monitor these tools and provide them "as is" and "as available" without any warranty or endorsement.

your use of any third-party tool is at your own risk. you should review the third party's own terms and privacy practices before using their tool. we have no liability for your use of any third-party tool.

we may add new tools or features over time. those will be governed by these same terms unless we publish separate terms for them.

8 · third-party links

the site may contain links or embedded content from third-party websites (instagram, payment processors, shipping carriers, review platforms, blog content, etc.). we are not responsible for:

the content, accuracy, or completeness of those sites
their privacy practices or terms of use
any product, service, or transaction you have with them

if you leave our site to access a third-party site, you do so at your own risk. complaints, claims, or questions about third-party content should go to the third party directly.

9 · relationship with shopify

blur society is powered by shopify, which enables us to provide the services to you. however, any sales and purchases you make in our store are made directly with blur society. by using the services, you acknowledge and agree that shopify is not responsible for any aspect of any sales between you and blur society, including any injury, damage, or loss resulting from purchased products and services. you hereby expressly release shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with blur society.

10 · privacy

all personal information collected through the site is governed by our privacy policy. since the site runs on shopify, certain information is also processed by shopify under shopify's consumer privacy policy (privacy.shopify.com/en).

by using the site, you acknowledge that you've read these privacy practices. your information may be transmitted to and stored in countries other than your home country (specifically canada and the united states).

11 · user submissions and feedback

if you submit any content to us — including reviews, photos, suggestions, ideas, feedback, comments, social media tags featuring our products, or any other materials (collectively, "feedback") — you grant blur society a:

perpetual, worldwide, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform that feedback in any medium, for any purpose, including commercial use.

you represent and warrant that:

you own all rights to the feedback or have permission to grant this license
you've disclosed any compensation or material connection you received in exchange for submitting the feedback (per ftc endorsement guidelines)
the feedback doesn't violate any law or third-party right (privacy, publicity, copyright, trademark)
the feedback is truthful and not misleading
you're not using a false identity or impersonating anyone else

we are under no obligation to: maintain feedback in confidence, pay you for it, respond to it, or keep it visible.

we may — at our sole discretion — edit, remove, or refuse to publish feedback that we determine is unlawful, offensive, defamatory, threatening, harassing, infringing, sexually explicit, deceptive, or otherwise objectionable.

you remain solely responsible for the feedback you submit and any consequences of it.

12 · errors, inaccuracies, and omissions

the site may occasionally contain typographical errors, inaccuracies, or omissions — particularly relating to prices, descriptions, promotions, shipping times, or stock availability. we reserve the right to correct any such errors and to update or cancel orders (including after submission) without prior notice if any information is inaccurate.

we are not obligated to update information on the site outside of as required by law.

13 · prohibited uses

you agree you will not use the site:

for any unlawful, fraudulent, or malicious purpose
to violate any international, federal, provincial, state, or local law
to infringe any intellectual property or proprietary right
to harass, abuse, defame, intimidate, or harm any person, including our staff, partners, or other users
to transmit false, misleading, or deceptive information
to send spam, chain messages, junk mail, or unsolicited advertising
to impersonate any person or entity, including blur society or shopify
to interfere with anyone else's use of the site
to collect or track personal information of others
to spam, phish, pharm, or pretext the site
to upload viruses, malware, or any harmful code
to reproduce, duplicate, copy, scrape, or systematically extract any part of the site
to use any robot, spider, scraper, automated tool, ai agent, or automated process to access the site except as expressly permitted under section 14
to bypass, disable, or circumvent any security or rate-limiting feature
to attempt to gain unauthorized access to any part of the site, server, or related infrastructure
to engage in any activity that we reasonably determine is harmful to blur society, shopify, our users, or third parties

we may suspend, disable, or terminate your account or access to the site at any time, without notice, if we believe you've violated any part of these terms.

14 · agents (ai and automation)

this section applies if you use, allow, enable, or cause the deployment of an agent to access, use, or interact with the site or services in any way.

"agent" means any software, ai system, autonomous program, or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can execute without direct human supervision for each action.

no agent may access, use, or interact with the site unless it:

identifies itself in every request. all http/https requests must include Agent/[agent name] in the user-agent string disclosing the name of the agent.
does not impersonate a human. the agent cannot mimic human behavior or interaction patterns to disguise its nature, and cannot solve, bypass, or circumvent captchas or any measure intended to distinguish humans from computers.
answers truthfully. if asked at any point in any interaction whether it's human or machine, the agent must respond truthfully.
respects controls. the agent must not bypass, ignore, or circumvent any technical measure we use to block, limit, or modify agent access — including robots.txt directives, rate limits, blocks, or any other restriction.
does not act if we've blocked it. if we have requested or signaled that a particular agent or class of agents should not access the site, that agent must immediately stop.

we may impose technical limits on whether and how any agent accesses, uses, or interacts with the site, at our sole discretion. violating any part of this section is grounds for immediate termination and may result in legal action.

15 · termination

we may terminate this agreement or your access to the site at our sole discretion at any time, with or without notice. on termination:

you'll remain liable for all amounts due up to and including the termination date
you'll cease all use of the site immediately
the following sections survive termination: intellectual property (§6), user submissions and feedback (§11), termination (§15), disclaimer of warranties (§16), limitation of liability (§17), indemnification (§18), severability (§19), waiver and entire agreement (§20), assignment (§21), governing law (§22), privacy (§10), and any other provisions that by their nature should survive.

16 · disclaimer of warranties

information on the site is provided for general informational purposes only. we don't warrant the accuracy, completeness, or usefulness of any of it. any reliance you place on site information is at your own risk.

EXCEPT AS EXPRESSLY STATED BY BLUR SOCIETY IN WRITING, THE SITE AND ALL PRODUCTS SOLD THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

SOME PROVINCES, STATES, OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES — IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

17 · limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLUR SOCIETY, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES BE LIABLE FOR ANY:

INJURY, LOSS, CLAIM, OR DAMAGES OF ANY KIND
DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES
LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST OPPORTUNITY, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES

WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF ANY PRODUCT IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES — IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

18 · indemnification

you agree to indemnify, defend, and hold harmless blur society, shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, or expenses (including reasonable attorneys' fees) payable to any third party arising from or related to:

your breach of these terms or any document incorporated by reference
your violation of any law or any third-party right (including ip, privacy, publicity, or contract rights)
your access to or use of the site
any feedback you submit
any unauthorized use of your account

we'll notify you of any claim we want indemnified, but a delay in notice doesn't relieve your obligation unless you're materially prejudiced. we may control the defense and settlement of any claim at your expense, including choice of counsel, but won't settle a claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). you agree to cooperate in the defense.

19 · severability

if any provision of these terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be severed. the remaining provisions will continue in full force and effect.

20 · waiver and entire agreement

our failure to exercise or enforce any right or provision of these terms does not constitute a waiver of that right or provision.

these terms — together with our privacy policy, refund policy, shipping policy, legal notice, and any other policies posted on the site — constitute the entire agreement between you and blur society regarding the site and supersede all prior agreements, communications, and proposals (oral or written) between you and us.

any ambiguity in interpretation will not be construed against the drafting party.

21 · assignment

you may not delegate, transfer, or assign these terms or any rights or obligations under them without our prior written consent. any attempt to do so is null and void. we may transfer, assign, or delegate these terms and our rights and obligations at any time without notice or consent.

22 · governing law and venue

these terms, and any disputes arising from or related to your use of the site or purchase of any product, are governed by and construed under:

the laws of the province of british columbia and the federal laws of canada applicable in british columbia
without regard to conflict-of-laws principles

any dispute, claim, or controversy arising from these terms or your use of the site will be resolved exclusively in the courts of british columbia, located in the city of vancouver (or new westminster, if applicable to the small claims or supreme court level). you and blur society consent to personal jurisdiction and venue in those courts.

if you are a resident of the united states or any other jurisdiction, you waive any objection to british columbia as the venue and the application of british columbia law.

this section does not deprive you of any non-waivable consumer-protection rights under the laws of your home province or state, where such protections cannot be waived by contract.

headings are included for convenience only. they don't limit or affect interpretation of these terms.

24 · changes to these terms

we may update these terms at any time. when we do:

the "last updated" date at the top of this page will change
material changes will be flagged via a site-wide banner for at least 7 days after the effective date
if you have an account, we may also email you about material changes
continued use of the site after changes take effect means you accept the revised terms

if you don't accept the revised terms, your only remedy is to stop using the site.
